LPB KIOSK TERMS AND CONDITIONS

1. LPB Kiosk is Operated By LPB Trading Corporation

SOFTWARE LICENSE

By installing or using the Software, you are representing to agree all the terms and conditions

2.2 LPB Kiosk License

Company grants you a limited, non-exclusive, non-transferable, revocable license to use the Software for your personal or internal business use, subject to the terms and conditions of this Agreement.

2. Restrictions

You shall not, and shall not allow any third party to:

• modify, adapt, translate, or create derivative works of the Software
• reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software
• remove, alter, or obscure any copyright, trademark, or other proprietary rights notices from the Software
• use the Software in any manner that violates any applicable laws or regulations

2.3.1 Distributor

Distributor is required to transfer license to customer. If the distributor does not transfer the license, LPB Kiosk has the right to suspend the distributor.

Builder

Builder is required to transfer the license to customer. If not transferred, LPB Kiosk has the right to suspend the builder.

2.4 Intellectual Property

The Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. All title and copyrights in and to the Software (including but not limited to any images, photographs, animations, video, music, text and "applets" incorporated into the Software) and any printed materials accompanying the Software are owned by the Company.

USER OBLIGATIONS

Keep your password secure and email. For any unsecured access or user negligence, LPB Kiosk is not liable.

Public Information

Software Updates

LPB Kiosk may provide updates, bug fixes, patches, or new features. These require manual installation to your machine. Also, at times LPB Kiosk may require fees for additional products, updates, and services.

6. HARDWARE WARRANTY

LPB Kiosk has a 1-month warranty only.

PLATFORM FEES

We have fees for GCash and Maya and other services: +₱2 for every ₱1-1000 and +₱1 for every ₱1000.

Bills Payment Fees

This depends on the service provider.

Cash-in Errors

LPB Kiosk is not liable in case of any typo error to the account number.
LPB Kiosk is not liable if you send money to a scammer not owned by LPB Kiosk.

1. SERVICE DOWNTIME

Customers, Distributors, and Builders agree to wait in case of downtime due to:

• Software bugs
• DDOS ATTACKS
• Hosting problems
• Server provider problems
• Removal of some products because of API issues

Bill Acceptor

LPB Kiosk shall not be liable for any loss or claim arising from the acceptance or rejection of counterfeit or fraudulent bills by bill acceptors used in its kiosks.

LPB Kiosk uses bill acceptors from third-party suppliers designed to detect and reject known counterfeit bills but may be susceptible to new or sophisticated counterfeits not in their recognition databases.

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LPB KIOSK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the kiosk or services;
• Any unauthorized access to or use of our servers and/or any personal information stored therein;
• Any interruption or cessation of transmission to or from the kiosk;
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our service by any third party;
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the kiosk.

IN NO EVENT SHALL LPB KIOSK'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO LPB KIOSK DURING THE PAST SIX (6) MONTHS.

15. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless LPB Kiosk, its parent corporation, officers, directors, employees, and agents, from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the LPB Kiosk service;
• Your violation of any term of these Terms;
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right;
• Any claim that your actions caused damage to a third party.

16. DISPUTE RESOLUTION

Any disputes arising from the use of LPB Kiosk services shall first be addressed through informal negotiation. If the dispute cannot be resolved through negotiation, both parties agree to resolve the dispute through mediation in Bacolod City, Philippines before resorting to arbitration or litigation.

17. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. You agree that any legal action or proceeding between you and LPB Kiosk shall be brought exclusively in the courts located in Bacolod City, Philippines.

18. REFUND POLICY

Due to the nature of digital transactions, LPB Kiosk generally does not provide refunds for completed transactions. In cases of technical error where a transaction was charged but not completed, refund requests must be submitted within 48 hours with complete transaction details and proof of payment. LPB Kiosk will investigate each claim and process valid refunds within 7-15 business days, depending on the payment method and service provider involved.

19. TERMINATION

LPB Kiosk reserves the right to terminate your access to the kiosk and its services, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

20. PRIVACY POLICY

Your use of LPB Kiosk services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.

21. FORCE MAJEURE

LPB Kiosk shall not be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service.

22. CHANGES TO TERMS AND CONDITIONS

LPB Kiosk reserves the right to update or modify these terms and conditions at any time without prior notice. Your continued use of the services following any changes indicates your acceptance of such changes.
